FindAKiwi (findakiwi.co.nz) is owned and operated by Aumnify AI Limited, a company registered in New Zealand (“we”, “us”, “our”). By using this website, creating an account, submitting or claiming a listing, or purchasing a plan, you agree to these terms. If you are using the site on behalf of a business, you confirm you have authority to bind that business.

1. What FindAKiwi is

FindAKiwi is a New Zealand business directory. We display business listings, contact details, reviews and related information so people can find and contact local businesses. We are a venue: we are not a party to any arrangement between a customer and a business found through the site, and we do not endorse or guarantee any listed business or its work.

2. Accounts

You need an account to submit or claim a listing, message a business, or leave a review. You must give accurate information, keep your login details secure, and be at least 16 years old. You are responsible for activity on your account. We may suspend or close accounts that break these terms.

3. Listings

Free and paid plans let you publish business listings. You must only list a business you own or are authorised to represent, and everything in your listing must be accurate and lawful. You keep ownership of your content and grant us a non-exclusive licence to host, display, and promote it on FindAKiwi and in our marketing.

Some listings on FindAKiwi were created from publicly available business information so that customers can find those businesses. If a listing is about your business you can claim it free of charge, after which you control its content. If you want a listing about your business corrected or removed instead, email kiaora@findakiwi.co.nz and we will action it within 10 working days.

We may edit, decline, or remove any listing or content that is inaccurate, unlawful, offensive, spam, or otherwise inconsistent with the purpose of the directory. Listing approval and claim verification are at our reasonable discretion. We verify claims against the New Zealand Business Number (NZBN) register and supporting documents you provide.

4. Paid plans and add-ons

Current prices are shown on our pricing page in New Zealand dollars. Payments are processed by Stripe; we do not store your card details.

• Pro is a monthly subscription. It renews automatically each month until you cancel. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period and you keep Pro features until then.
• Featured Listing is a one-off purchase that features one listing for 30 days. It does not renew.
• Claiming a listing is free.

If a subscription payment fails we will retry it and email you so you can update your payment method. If payment is still unsuccessful after our retries, the subscription is paused until payment is made. We may change plan prices with at least 30 days’ notice by email; the new price applies from your next renewal after the notice period.

5. Refunds

Our refunds policy sets out how refunds work. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you acquire our services for business purposes, you agree that the Consumer Guarantees Act does not apply, as permitted by section 43(2) of that Act.

6. Reviews and messages

Reviews must reflect your genuine experience with the business. You must not post reviews of your own business or a competitor’s, offer or accept payment for reviews, or post anything defamatory, misleading, or unlawful. We may remove reviews that appear to breach these rules. Messages sent through the site must relate to the listed business and must not be spam.

7. Acceptable use

You must not scrape or bulk-extract data from the site, interfere with its operation, misrepresent your identity or affiliation, upload malicious code, or use the site to break any law, including the Fair Trading Act 1986 and the Unsolicited Electronic Messages Act 2007.

8. Intellectual property

The FindAKiwi name, site design, and software are ours or our licensors’. Business names and logos shown in listings belong to their respective owners and are displayed for identification.

9. Privacy

Our privacy policy explains how we collect and handle personal information under the Privacy Act 2020.

10. Liability

We work to keep the site accurate and available but provide it “as is”. We are not liable for the conduct, workmanship, or solvency of any listed business, for content supplied by users, or for loss of profits or indirect loss. Where we are liable and the law allows liability to be limited, our total liability is capped at the amount you paid us in the 12 months before the event giving rise to the claim, or NZ$100 if you have paid nothing. Nothing in these terms excludes liability that cannot be excluded under New Zealand law.

11. Ending or changing the service

We may change or discontinue features with reasonable notice. If we discontinue a paid feature you have already paid for, we will refund the unused portion. We may update these terms; material changes will be notified by email or a site notice at least 14 days before they take effect, and continued use after that date is acceptance.

12. Governing law

These terms are governed by New Zealand law and the New Zealand courts have exclusive jurisdiction.
